Personal injury
- Car crashes

- Construction accidents under Labor Law Section 240(1) and Section 241(6)

- Claims against a county, town, village or other public body
- Wrongful death
A claim against a public corporation usually needs a notice of claim. Under General Municipal Law Section 50-e(1)(a), it has to be served within ninety days after the claim arises; in a wrongful death action, the ninety days run from the appointment of a representative of the estate. If that date is close, call instead of using the form.
Employment

- Whistleblower claims, including Civil Service Law Section 75-b for public employees
- Discrimination under the New York State Human Rights Law and the New York City Human Rights Law
- Unpaid wages and overtime

How a Referral Works
- Step 1
Send the names of the parties for a conflict check and a short summary of the case. Hold privileged detail until the conflict check clears.
- Step 2
My office runs the conflict check. Then we talk about the case, the deadlines and whether it is a referral, a co-counsel arrangement or an appeal.
- Step 3
If I take the case, the division of the fee and each lawyer's share are disclosed to the client, and the client's agreement is confirmed in writing, as Rule 1.5(g) requires.
Referral Fees and Co-Counsel Under New York Rule 1.5(g)
Under Rule 1.5(g) of the New York Rules of Professional Conduct (22 NYCRR Part 1200), a lawyer may divide a fee with a lawyer who is not in the same firm only when all three of these conditions are met:
- The division is in proportion to the services each lawyer performs, or each lawyer assumes joint responsibility for the representation in a writing given to the client.
- The client agrees to the employment of the other lawyer after full disclosure that the fee will be divided, including the share each lawyer will receive, and the client's agreement is confirmed in writing.
- The total fee is not excessive.
Rule 7.2(a)(2) allows a lawyer to pay a referral fee to another lawyer only as Rule 1.5(g) permits.
For a matter in another state, that state's rules on fee division govern, and the arrangement has to meet them.
