He has successfully challenged arbitrators' failure to consider AMA guidance in ascertaining reimbursable service amounts, their adherence to the rules of evidence when those rules are significantly relaxed at arbitration, and their failure to consider evidence as to the relatedness of medical equipment to an injury.
In his role as a plaintiff attorney, Mr. Tenenbaum convinced the Appellate Division that an injured person who pays their medical billings has standing to prosecute a claim for denied benefits against an insurance company — notwithstanding an assignment of benefits transferring that right to a medical provider. He also established that an attorney fee is required for all work performed in moving to confirm a no-fault master arbitration award.
Notable cases
One notable case from 2013 involved $40,000 in disputed massage therapy benefits rendered after an IME. A Kingston, New York jury found the testimony of the defense medical examiner and the injured person's treating physician — who concluded all further care would be palliative — more credible than the testimony of the referring physiatrist, the massage therapist, and the injured person.
Jason has also been involved with the trial and appeal of dozens of personal injury, employment, and other matters in Federal and State Courts. One landmark case involved a Broward County, Florida insurer that ignored a letter seeking payment of a $25,000 policy limit. Under threat of Florida's bad faith laws, the case was settled for $1,000,000.
